Is your vote being questioned by Judge Griffin?

Here's how to find out and what to do

Republican candidate Jefferson Griffin lost the November 2024 election to Democrat Allison Riggs in the North Carolina Supreme Court race, but he is not accepting the results and is asking the courts to throw out more than 65,000 votes, claiming they were cast by ineligible voters.

According to official counts from the North Carolina State Board of Elections (NCSBE), Griffin lost the election by 734 votes, but the results could not be certified due to the Republican candidate’s claim in state courts.

Griffin’s claim was rejected by the NCSBE and a Wake County court, but on April 4, the State Court of Appeals ruled in his favor and ordered election officials to notify affected voters to confirm their eligibility within 15 days after being notified.

That order was appealed to the state Supreme Court, which on Friday, April 11, ruled partially against Griffin, rejecting his request to void 60,273 votes from voters who registered without providing their Social Security or driver’s license numbers.

However, the Supreme Court did uphold some of Griffin’s claims. One of them questions the validity of between 1,409 and 5,509 votes cast by mail by military personnel, their families, and other civilians abroad without presenting valid identification.

The ruling gives these voters 30 days to send a copy of their identification to the election authorities in the counties where they registered, otherwise their votes would be voided.

The Supreme Court also upheld the Court of Appeals’ decision to void 267 votes cast abroad by citizens who do not reside in the country but are children of state residents.

The State Supreme Court order is not yet in effect because the case is being appealed to federal courts.

Which votes are being questioned?

Griffin is questioning more than 65,000 votes cast by three specific groups of voters that he considers ineligible:

  • Those who registered to vote without filling out all the required information, such as their social security number or driver’s license number.
  • Civilians and members of the armed forces living abroad who voted by mail without attaching a copy of a valid ID to vote.
  • U.S. citizens abroad who never lived in the country but who voted because they are children of citizens residing in North Carolina.

What should I do if my name is listed?

Although the State Supreme Court’ order is not yet in effect, the NCBOE reported that affected voters can do the following.

  1. If you did not provide your SS or Driver License number when registering, you can update your voter registration:
  • If you have a driver’s license, you can do so online on the page: payments.ncdot.gov
  • If you do not have a driver’s license, you can download a registration form on the ncsbe.gov/register-mail page. You must print, fill out, and sign it, then take it or mail it to your county Board of Elections.
  1. If you are a military or civilian abroad who voted by mail, you can send a photocopy of a valid voter ID to your County Board of Elections. You can do this by mail, email, or in person.
